class=\"elementor-heading-title elementor-size-default\">These Code of Ethics have been laid down by the Professional Speakers Association of India (PSAI) for the effective\nand efficient management of the association and the behaviour of its members within PSAI and outside PSAI in a\nmanner that upholds the PSAI\u2019s values \u2013 RESPECT, INTEGRITY, TRUST, EXCELLENCE, GLOBAL MINDSET,\nSTEWARDSHIP, MUTUALITY, MENTORSHIP - in personal and professional spaces.<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-07939bc elementor-widget elementor-widget-heading\" data-id=\"07939bc\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">This Code of Ethics will apply to all PSAI members which also include members holding places of office at the national\nor chapter level, in their work as a professional speaker defined below:\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-32706f3 elementor-widget elementor-widget-heading\" data-id=\"32706f3\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Professional speaker is one who speaks professionally, delivers training, keynotes, workshops and seminars as a\nmajor part of his\/her business.\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-6556f88 elementor-widget elementor-widget-heading\" data-id=\"6556f88\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">PSAI expects from its members, that should an ethical issue arise during their membership, they shall cooperate with\nPSAI in dealing with it in accordance with these Code of Ethics.\n<\/h2>\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-7fd339a e-con-full e-flex wpr-particle-no wpr-jarallax-no wpr-parallax-no wpr-sticky-section-no class=\"elementor-heading-title elementor-size-default\">Professional Conduct: <\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8e05a39 elementor-widget elementor-widget-heading\" data-id=\"8e05a39\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Membership to PSAI comes with the responsibility on the members to respect, adhere and practice PSAI\u2019s values - \u2013\nRESPECT, INTEGRITY, TRUST, EXCELLENCE, GLOBAL MINDSET, STEWARDSHIP, MUTUALITY, MENTORSHIP \u2013 and\nPSAI expects that its members shall act according to PSAI values at all times, whether they are representing PSAI, or\nreferencing PSAI or when working in their speaking business<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f835a42 elementor-widget elementor-widget-heading\" data-id=\"f835a42\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">In the speaking profession many topics and opinions, many ideas, experiences and backgrounds, and skillsets come\ntogether. PSAI members will always value, respect each other\u2019s contributions and work professionally, collectively\nand individually in the speaking community and otherwise also. PSAI members who are the brand ambassadors of\nPSAI will also ensure that they give due credit to other speakers, authors, researchers, thinkers and originator or the\nwork, thought or idea that they use in their talks.\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-3fa73c8 e-con-full e-flex wpr-particle-no wpr-jarallax-no wpr-parallax-no wpr-sticky-section-no wpr-column-slider-no wpr-equal-height-no e-con e-child\" data-id=\"3fa73c8\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-182a287 elementor-widget elementor-widget-heading\" data-id=\"182a287\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">The Reputation of the Profession<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-20ddbc1 elementor-widget elementor-widget-heading\" data-id=\"20ddbc1\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">The reputation of PSAI is no different from that of PSAI members. Both influence each other. Therefore, both PSAI\nand its members shall be mindful of protecting and upholding the reputation of each other. However, if any member\nis found guilty of misconduct under these Code of Ethics and action is taken against such a member, then such\nmember will not hold PSAI responsible for tarnishing or damaging the member\u2019s reputation.\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-d06d0e9 e-con-full e-flex wpr-particle-no wpr-jarallax-no wpr-parallax-no wpr-sticky-section-no wpr-column-slider-no wpr-equal-height-no e-con e-child\" data-id=\"d06d0e9\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-60a1d94 elementor-widget elementor-widget-heading\" data-id=\"60a1d94\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Professional Requirements<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-47b7d3d elementor-widget elementor-widget-heading\" data-id=\"47b7d3d\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Members shall always:\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-066dcf4 elementor-widget elementor-widget-text-editor\" data-id=\"066dcf4\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<ul><li>Take care that their speaking business meets the professional liability law of the country in which they are<br \/>speaking or operating their speaking business from.<\/li><li>Comply with all relevant laws, regulations, and tax obligations in connection with their speaking business.<\/li><li>Hold the necessary licences and permissions to use images, music, video, and other content that they desire<br \/>to use in their presentations.<\/li><li>Ensure that the terms of engagement have been mutually agreed upon with their clients and preferably a<br \/>written contract or exchange of confirmation letters are in place before any work is undertaken. It is also to be clearly understood that in the event of any dispute between the member and the member\u2019s client, PSAI<br \/>will neither be responsible nor become a party to the dispute in any manner.<\/li><li>Act in accordance with this code.<\/li><li>Alert PSAI of any situation which the member feels might adversely affect the reputation of the PSAI, which<br \/>the member cannot resolve. On receipt of such information, it will be PSAI\u2019s prerogative to deal with the<br \/>news as it deems fit. The informant shall not try to influence PSAI to decide or act in a particular way.<\/li><li>Adhere to the various procedures and systems that are put in place by PSAI at the national or chapter level<br \/>for the smooth and improved working of PSAI. In case the member suffers any loss or is put in a<br \/>disadvantageous position because of non-adherence to the procedures and systems, PSAI shall not be<br \/>responsible.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-dc85f98 e-con-full e-flex wpr-particle-no wpr-jarallax-no wpr-parallax-no wpr-sticky-section-no wpr-column-slider-no wpr-equal-height-no e-con e-child\" data-id=\"dc85f98\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-3b3a07f elementor-widget elementor-widget-heading\" data-id=\"3b3a07f\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Professional Conduct<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-12e01a0 elementor-widget elementor-widget-heading\" data-id=\"12e01a0\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Members will always conduct themselves professionally. They shall take into account the laws of the land, common\nstandards of decency and context, be polite and do not intentionally insult, belittle or offend others (including on\nsocial media and other online interactions). This includes, but is not limited to:\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d47fc34 elementor-widget elementor-widget-text-editor\" data-id=\"d47fc34\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<ul><li>Making threats of using any form of physical violence<\/li><li>Persistent or unwelcome encroachment of personal space<\/li><li>Unwelcome sexual attention in any form<\/li><li>Emotional manipulation and abuse<\/li><li>Making or using inappropriate discriminatory jokes and language<\/li><li>Inflicting personal insult directly or indirectly by using discriminatory terms<\/li><li>Any type of blackmail, defamation, or seeking to harm the reputation or business of others<\/li><li>Making false complaints with an intent to harm and tarnish the image of another member<\/li><li>Advocating for, or encouraging, any of the above behaviour<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-32f3472 elementor-widget elementor-widget-heading\" data-id=\"32f3472\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">If any member is subjected to any of these behaviours, or observe such behaviour of any member causing discomfort\nto other members, it shall be reported with details in writing to PSAI.<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-649450a e-con-full e-flex wpr-particle-no wpr-jarallax-no wpr-parallax-no wpr-sticky-section-no wpr-column-slider-no wpr-equal-height-no e-con e-child\" data-id=\"649450a\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-02baf90 elementor-widget elementor-widget-heading\" data-id=\"02baf90\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Bullying and Harassment<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-585daac elementor-widget elementor-widget-heading\" data-id=\"585daac\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\"><b>Bullying<\/b> can be described as unwanted behaviour from a person or group that is either \u2013<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d3ace68 elementor-widget elementor-widget-text-editor\" data-id=\"d3ace68\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<ul><li>offensive, intimidating, malicious or insulting and arising out of abusive conduct or misuse of power that<br \/>undermines, humiliates, or causes physical or emotional harm to someone<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-661346b elementor-widget elementor-widget-text-editor\" data-id=\"661346b\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>The bullying could be &#8211;<\/p><ul><li>a regular pattern of behaviour or a one-off incident; happen face-to-face, on social media, in emails or calls;<br \/>happen at work or in other work-related situations; not always obvious or noticed by others.<\/li><li>Examples of bullying (these examples are indicative but not exhaustive) &#8211;<br \/>A member spreading malicious rumour about another member; one member putting humiliating, offensive<br \/>or threatening comments or photos on social media about another member or members.<\/li><\/ul><p><strong>Harassment<\/strong> is defined as \u201cany act that causes physical or mental injury\u201d in Indian law and includes violating the<br \/>complainant\u2019s dignity, or creating an intimidating, hostile, degrading, humiliating or offensive environment for the<br \/>complainant.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-69dfd45 elementor-widget elementor-widget-heading\" data-id=\"69dfd45\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">The PSAI is committed to providing an environment that is comfortable and free from all forms of bullying and\nharassment.\nPSAI will take all complaints of bullying and harassment seriously when received in writing and direct the complaint\nto its ethics committee for further action on the complaint. The decision of the committee will be final.\nIf the PSAI Board thinks necessary on the recommendation of the investigating committee, it has the powers to pass\nstrictures, suspension and \/ or termination of membership if it is deemed necessary in the interest of PSAI.\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-990d00a e-con-full e-flex wpr-particle-no wpr-jarallax-no wpr-parallax-no wpr-sticky-section-no wpr-column-slider-no wpr-equal-height-no e-con e-child\" data-id=\"990d00a\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-b88469e elementor-widget elementor-widget-heading\" data-id=\"b88469e\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Diversity &amp; Inclusion<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-45bfe29 elementor-widget elementor-widget-heading\" data-id=\"45bfe29\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">PSAI believes in and respects diversity and inclusion. PSAI encourages and respects the fact that different people\nhave different perspectives on issues. Being unable to understand why someone holds a viewpoint doesn\u2019t mean that\nthey\u2019re wrong. PSAI discourages blaming each other. Only those complaints that are in connection with the\nspeaking business of the member will be entertained. The complaints will need to be in writing and sent to the\nPresident PSAI by emailing at president@psai.in<br><br>\nThe President will direct the complaint to the ethics committee for investigation and appropriate action in the\ninterest of the wellbeing of its member and PSAI.<br><br>\nPSAI is acutely aware that it takes courage to come forward and share concerns. PSAI treats all concerns with\nappropriate vigour and fairness. PSAI members will always value, respect each other\u2019s contributions and work professionally, collectively and individually in the speaking community and otherwise also. PSAI members who are the brand ambassadors of PSAI will also ensure that they give due credit to other speakers, authors, researchers, thinkers and originator or the work, thought or idea that they use in their talks. The Reputation of the Profession The reputation of PSAI is no different from that of PSAI members. Both influence each other. Therefore, both PSAI and its members shall be mindful of protecting and upholding the reputation of each other. However, if any member is found guilty of misconduct under these Code of Ethics and action is taken against such a member, then such member will not hold PSAI responsible for tarnishing or damaging the member\u2019s reputation. Professional Requirements Members shall always: Take care that their speaking business meets the professional liability law of the country in which they arespeaking or operating their speaking business from. Comply with all relevant laws, regulations, and tax obligations in connection with their speaking business. Hold the necessary licences and permissions to use images, music, video, and other content that they desireto use in their presentations. Ensure that the terms of engagement have been mutually agreed upon with their clients and preferably awritten contract or exchange of confirmation letters are in place before any work is undertaken. It is also to be clearly understood that in the event of any dispute between the member and the member\u2019s client, PSAIwill neither be responsible nor become a party to the dispute in any manner. Act in accordance with this code. Alert PSAI of any situation which the member feels might adversely affect the reputation of the PSAI, whichthe member cannot resolve. On receipt of such information, it will be PSAI\u2019s prerogative to deal with thenews as it deems fit. The informant shall not try to influence PSAI to decide or act in a particular way. Adhere to the various procedures and systems that are put in place by PSAI at the national or chapter levelfor the smooth and improved working of PSAI. In case the member suffers any loss or is put in adisadvantageous position because of non-adherence to the procedures and systems, PSAI shall not beresponsible. Professional Conduct Members will always conduct themselves professionally. They shall take into account the laws of the land, common standards of decency and context, be polite and do not intentionally insult, belittle or offend others (including on social media and other online interactions). This includes, but is not limited to: Making threats of using any form of physical violence Persistent or unwelcome encroachment of personal space Unwelcome sexual attention in any form Emotional manipulation and abuse Making or using inappropriate discriminatory jokes and language Inflicting personal insult directly or indirectly by using discriminatory terms Any type of blackmail, defamation, or seeking to harm the reputation or business of others Making false complaints with an intent to harm and tarnish the image of another member Advocating for, or encouraging, any of the above behaviour If any member is subjected to any of these behaviours, or observe such behaviour of any member causing discomfort to other members, it shall be reported with details in writing to PSAI. Bullying and Harassment Bullying can be described as unwanted behaviour from a person or group that is either \u2013 offensive, intimidating, malicious or insulting and arising out of abusive conduct or misuse of power thatundermines, humiliates, or causes physical or emotional harm to someone The bullying could be &#8211; a regular pattern of behaviour or a one-off incident; happen face-to-face, on social media, in emails or calls;happen at work or in other work-related situations; not always obvious or noticed by others. Examples of bullying (these examples are indicative but not exhaustive) &#8211;A member spreading malicious rumour about another member; one member putting humiliating, offensiveor threatening comments or photos on social media about another member or members. Harassment is defined as \u201cany act that causes physical or mental injury\u201d in Indian law and includes violating thecomplainant\u2019s dignity, or creating an intimidating, hostile, degrading, humiliating or offensive environment for thecomplainant.
